These Terms of Service ("Terms") govern your access to and use of the Samayish Growth website and any related pages, forms and tools (together, the "Website"). "Samayish Growth", "we", "us" and "our" refer to the business that operates the Website. "You" means the person or business using the Website.
Please read these Terms carefully. By accessing or using the Website you agree to be bound by them and by our Privacy Policy and Cookie Policy. If you are using the Website on behalf of a business, you confirm that you have authority to bind that business. If you do not agree, do not use the Website.
1. About Our Services
Samayish Growth provides growth systems for local service businesses, which may include lead capture, missed-call text back, speed-to-lead follow-up, CRM setup and automation, booking and reminders, lead recovery, customer reactivation, review generation, local SEO, paid advertising and reporting. The Website describes these services in general terms only and does not by itself create a contract for any specific service.
2. Engagements and Written Agreements
Any paid work is governed by a separate written proposal, statement of work or services agreement signed or accepted by you and Samayish Growth. That agreement sets out scope, timelines, fees, responsibilities and any additional terms. If it conflicts with these Terms, the written agreement prevails for that work. Booking a strategy call, requesting an audit or submitting a form does not oblige either party to enter into an engagement.
3. Use of the Website
You may use the Website only for lawful purposes and in line with these Terms. You agree not to:
- Use the Website in any way that breaks applicable law or regulation.
- Attempt to gain unauthorized access to the Website, our servers, systems or data, or to those of other users.
- Introduce viruses, malware or any harmful or disruptive code.
- Scrape, copy, harvest or mine content or data from the Website by automated means without our written permission.
- Interfere with or overload the Website or its infrastructure.
- Submit false, misleading or fraudulent information, or impersonate any person or business.
- Use the Website to send unsolicited or unlawful communications.
- Reverse engineer or attempt to extract the source code of any part of the Website, except where the law allows.
4. Information You Submit
When you submit information through the Website, you confirm that it is accurate and that you have the right to share it. You grant us permission to use it to respond to you, assess whether our services fit your needs and prepare for any call or proposal, as described in our Privacy Policy. Please do not submit sensitive information such as payment card numbers, government identifiers or health records through website forms.
5. Communications and Messaging Compliance
By giving us your contact details you agree that we may contact you about your enquiry and our services by email, phone and text message, subject to your right to opt out at any time. If we build or operate messaging, calling or email systems for you, you are responsible for making sure your own use of them complies with laws that apply to your business and your customers, including consent, opt-out, calling-hour, recording and marketing rules such as the TCPA, CAN-SPAM and applicable privacy laws. We configure tools on your instructions but do not provide legal advice.
6. Intellectual Property
The Website and its content, including text, graphics, logos, icons, images, designs, layouts, code, frameworks, methods and the Samayish Growth name and marks, are owned by Samayish Growth or its licensors and are protected by intellectual property laws. You may view and print pages for your own internal business use. You may not copy, reproduce, modify, distribute, publicly display or create derivative works from any content without our prior written permission. Ownership of deliverables created under a paid engagement is governed by the written agreement for that engagement.
7. Third-Party Tools, Platforms and Links
Our services and the Website may rely on or link to third-party platforms, such as CRMs, phone and messaging providers, advertising networks, review sites, analytics tools and social media. Those third parties have their own terms, fees, limits and policies, which may change and which we do not control. We are not responsible for their content, availability, performance or practices. Third-party names, logos and trademarks belong to their owners and appear for identification only, without implying endorsement.
8. No Guarantee of Results
Any results, statistics, benchmarks, timelines or examples on the Website are illustrative only and are not promises of future performance. Outcomes depend on many factors outside our control, including your market, competition, offer, pricing, budget, team, response times, seasonality and platform changes. We do not guarantee any specific revenue, lead volume, ranking, review count or return on investment.
9. Disclaimer of Warranties
The Website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant that the Website will be secure, free of harmful components or always available. Content on the Website is general information and is not legal, financial, tax or other professional advice.
10. Limitation of Liability
To the fullest extent permitted by law, Samayish Growth and its owners, employees, contractors and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or related to your use of or inability to use the Website, even if we have been told such damage is possible. Our total liability for any claim relating to the Website will not exceed one hundred US dollars (USD 100). Liability for paid services is limited as set out in the applicable written agreement. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Indemnification
You agree to defend, indemnify and hold harmless Samayish Growth and its owners, employees and contractors from claims, damages, losses and expenses, including reasonable legal fees, arising out of your misuse of the Website, your breach of these Terms, the information you submit, or your violation of any law or third-party right.
12. Suspension and Termination
We may suspend or restrict your access to the Website at any time, without notice, if we believe you have broken these Terms or if needed to protect the Website or others. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, will continue to apply.
13. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Samayish Growth is established, without regard to conflict-of-law rules. Before starting any formal proceeding, both parties agree to try in good faith to resolve the dispute by contacting each other and negotiating for at least thirty days. Any dispute that cannot be resolved informally will be brought in the courts of that jurisdiction, and you consent to their jurisdiction and venue, unless your written agreement with us says otherwise or mandatory consumer law in your location provides differently.
14. Changes to the Website and These Terms
We may change, suspend or remove any part of the Website at any time. We may also update these Terms from time to time. The date at the top shows the latest revision. Your continued use of the Website after changes are posted means you accept the updated Terms.
15. General Provisions
- Entire agreement: these Terms, together with our Privacy Policy, Cookie Policy and any written agreement with you, are the entire agreement between us about the Website.
- Severability: if any provision is found to be unenforceable, the rest remain in effect.
- No waiver: failure to enforce a right is not a waiver of that right.
- Assignment: you may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control.
- Electronic communications: you agree that we may give you notices by posting them on the Website or by email.
